By accessing or using Makelist ("the Service"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the Service.
We reserve the right to modify these terms at any time. Continued use of the Service after any changes constitutes acceptance of the modified terms.
2. Service Description
Makelist is a free web application that:
- Extracts tracklist information from YouTube video content
- Searches the Spotify catalogue for matching tracks
- Creates Spotify playlists on behalf of authenticated users
The Service is provided free of charge. We make no guarantees regarding availability, uptime, or uninterrupted access.
3. Eligibility
To use Makelist, you must:
- Be at least 13 years of age
- Have a valid Spotify account to create playlists
- Comply with Spotify's and YouTube's terms of service
- Have the legal capacity to enter into a binding agreement
4. User Responsibilities
When using the Service, you agree to:
- Provide accurate information when connecting your accounts
- Maintain the security of your Spotify and Google accounts
- Use the Service only for lawful purposes
- Not attempt to circumvent, disable, or interfere with the Service
- Not use the Service to infringe upon intellectual property rights
- Not use automated systems or bots to access the Service
5. Third-Party Services
Makelist relies on third-party services to function. By using Makelist, you also agree to comply with:
We are not responsible for changes to third-party services that may affect the functionality of Makelist. If Spotify or YouTube modify their APIs or terms, the Service may be affected or discontinued without notice.
6. Intellectual Property
- We do not claim ownership of any content from Spotify or YouTube
- You retain all rights to playlists created using our Service
- The Makelist name, logo, and service design are our property
- Spotify and YouTube are trademarks of their respective owners
7. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.
We do not warrant that:
- The Service will be uninterrupted, secure, or error-free
- Track matching will be 100% accurate
- All tracks from extracted tracklists will be available on Spotify
- The Service will meet your specific requirements
8. Limitation of Liability
To the fullest extent permitted by law, Makelist shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
As the Service is provided free of charge, our maximum liability for any claim is limited to zero pounds sterling (£0).
9. Indemnification
You agree to indemnify and hold harmless Makelist from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these terms, or your infringement of any third-party rights.
10. Termination
- We may suspend or terminate your access to the Service at any time, for any reason, without notice
- You may stop using the Service at any time by disconnecting your Spotify account
- Upon termination, any data associated with your use will be deleted in accordance with our Privacy Policy
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.
Any disputes arising from these terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
12. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
13. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Makelist regarding the use of the Service.
